Terms of Service for Seducify AI

1. Introduction

"We," "Our," or "Us" refer to Seducify AI, a trade name of Pixelheads B.V., registered in The Netherlands with the Chamber of Commerce under number 69959447, located at De Nieuwe Erven 3, 5431 NV Cuijk. These Terms of Service ("Terms") govern your use of Seducify AI (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

You must be at least 18 years old to use the Service.

2. Changes to the Terms

We may update these Terms from time to time. When we do, we will notify you via email or post the updated Terms on our website. It is your responsibility to review these Terms regularly. Continued use of the Service after changes are posted means you accept the revised Terms.

3. Eligibility and Account Registration

To use Seducify AI, you must register an account. By creating an account, you confirm that you are providing accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activities under your account.

3.1 Age Restriction

You must be at least 18 years old to use the Service. By registering, you confirm that you meet this age requirement.

4. Subscriptions, Payments, and SeduceCoins

The Service offers subscription-based access to certain features, as well as in-app currency ("SeduceCoins"). By subscribing or purchasing SeduceCoins, you agree to pay all applicable fees.

4.1 Subscription Plans

We offer different subscription plans. Your subscription will automatically renew unless you cancel it through your account settings prior to the renewal date.

4.2 SeduceCoins

SeduceCoins can be purchased and used within the Service. They have no real-world monetary value and cannot be refunded, transferred, or exchanged for cash.

4.3 Refunds

We evaluate refund requests on a case-by-case basis. If you experience any issues with your purchase, please contact our support team at [email protected] within 14 days of the transaction. We reserve the right to approve or deny any refund request in our sole discretion.

5. Use of the Service

You agree to use Seducify AI only for lawful purposes and in accordance with these Terms. You are solely responsible for the content and activities you post or engage in while using the Service.

5.1 Prohibited Conduct

You agree not to:

  • Use the Service for any illegal activities.
  • Impersonate any person or entity, or falsely claim an affiliation.
  • Post content that is abusive, defamatory, obscene, or otherwise inappropriate.
  • Engage in spamming, phishing, or any form of exploitation of other users.
  • Attempt to reverse-engineer or tamper with the Service.

We reserve the right to investigate and take legal action in response to any violation of these rules.

5.2 Artificial Intelligence Interactions

Users of Seducify AI acknowledge and agree that:

  • All interactions on the platform are with artificial intelligence characters and not real people
  • AI characters are incapable of forming genuine emotional connections or relationships
  • Any perceived emotional or personal connection with an AI character is artificial and should not be acted upon in the real world
  • Users are solely responsible for their emotional and psychological well-being when using the Service
  • Seducify AI is not a substitute for professional mental health services or real-world relationships

Users agree to use the Service responsibly and to seek professional help if they experience any negative emotional or psychological effects from their use of the Service.

6. User-Generated Content

You retain ownership of the content you submit to Seducify AI. However, by submitting content, you grant Pixelheads B.V. a worldwide, royalty-free, irrevocable license to use, modify, and display your content as part of the Service.

You agree not to submit content that infringes on the rights of others or violates any laws. We may remove or modify any content at our discretion.

7. Intellectual Property

All elements of Seducify AI, including but not limited to the code, design, logos, AI-generated content, and interactive features, are owned by Pixelheads B.V. or licensed to us. You may not use our intellectual property without our express written permission.

8. Privacy

Your use of Seducify AI is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

9. Service Availability and Modifications

We strive to keep Seducify AI available and functioning at all times, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any aspect of the Service at any time without liability.

10. Disclaimer of Warranties and Limitation of Liability

Seducify AI is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of fitness for a particular purpose and non-infringement. You understand and agree that your use of Seducify AI is at your own risk. We are not responsible for any emotional distress, psychological harm, or any other damages that may result from your interactions with our AI characters. Our AI characters are not real people and are not capable of forming genuine relationships. Any perceived emotional connection is artificial and should not be taken as real or acted upon in the real world. In no event shall Pixelheads B.V. be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Seducify AI, including but not limited to emotional distress, psychological harm, or actions taken based on interactions with our AI characters. Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid to us in the last twelve months.

11. Limitation of Liability

In no event shall Pixelheads B.V. be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Seducify AI. Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid to us in the last twelve months.

12. Termination

We reserve the right to suspend or terminate your account at any time if we determine, in our sole discretion, that you have violated these Terms or pose a risk to the Service or its users. Upon termination, your right to use the Service will cease immediately.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of The Netherlands. Any disputes arising out of or in connection with these Terms shall be resolved by the competent courts of The Netherlands.
